Focus on

Starting November 11, 2024, the Chamber of Commerce of Milan, Monza Brianza, and Lodi will require all Certificates of origin to be printed on  PLAIN PAPER. This aligns with the practices already adopted by major Italian and European Chambers of Commerce.
By their code C23XXXXXXXX, you can verify certificates of origin online through the International Chamber of Commerce's website  or the National Database of Certificates of Origin
The certificate can be sent digitally to the final recipient, eliminating the need for a printed copy.

Russia-Ukraine War

Due to the Russian invasion of Ukraine and the consequent restrictions approved at the international level, Unioncamere announced that the issue of ATA Carnet for the three countries directly or indirectly involved in the war (Russian Federation, Ukraine, and Belarus) is currently suspended.

The issue of certificates of origin goes on; however, the company must attach to the relevant application a declaration (available only in Italian) highlighting that the products listed in the certificate and their addressees are not subject to the penalties laid down by EU regulations.

Currently, there is not a general ban on exports nor a ban on the issue of certificates of origin but, since the situation is constantly evolving, companies must be aware that they have to:

  • verify upstream if their products are included in the categories subject to restrictions imposed by EU or Russian regulations;
  • pay special attention to the so-called “dual-use items”. In doubtful cases, companies should consult the Italian National Authority – UAMA (Unit for the Authorizations of Armament Materials) – which issues authorizations for the export, transfer, brokering, technical assistance, and transit of dual-use items, and for direct and indirect trade of items listed as a result of EU restrictive measures;
  • verify together with UAMA, in doubtful cases, if any authorization is required for their products;
  • verify that their products will not be sent to any natural/legal person subject to penalties;
  • take into consideration that the financial restrictions imposed, which are becoming increasingly rigid, might result in the blocking of bank payments, and therefore put customer payments at risk.

The Ministry of Economic Development and the Ministry of Foreign Affairs set up two dedicated crisis units to assist companies having business relations with Russia, Belarus, and Ukraine.

It is mandatory to send/ pay requests of certificates of origin online, using the “print-it-yourself” mode. If you don’t choose the “print-it-yourself” mode, your request will be rejected.

 

What it is about

The certificate of origin is an official document certifying either the place of production, extraction, or manufacture of goods or the place where the latest substantial transformation took place. It does not certify the shipment of goods, nor can it be considered a document of title (a category that includes bills of lading, CMR notes, etc.).
 

What it is for

  • Credit: it can be used to request a letter of credit;
  • Customs: when goods are cleared, it can be used by the competent authorities of an importing country to choose the appropriate customs treatment.

It can only be used when a trade relationship is between an EU and a non-EU country because within the EU it is sufficient that the goods are accompanied by the invoice, on which it is customary to declare the origin of the goods (see also EEC Regulation 2454/1993).
 

How to request it

You can request a certificate of origin from the Chamber of Commerce that is competent for the area where the business holds its registered office /branch, which must be registered with the Business Register or the Economic and Administrative Index (REA).

By way of exception, and with prior authorization of the competent Chamber of Commerce, you can request it from the Chamber competent for the area where the goods are located. The certificate can be requested, via online submission and payment, by the owner of a sole proprietorship or by the legal representative of a company.

certificate of origin can be issued only when there is no agreement on duty benefits between different countries. In this case, the origin of goods is defined as “non-preferential”, and the relevant certificate ascertains the exact production place of the goods or the place where the latest substantial transformation took place. Otherwise, if there are specific agreements between the interested countries, the origin of goods, which can be defined as “preferential”, is certified by customs authorities on the basis of such agreements, and there is no need for a certificate of origin.
