Administrative irregularities that violate the rules on the Business Register fall into two categories:

  • Late submission of applications, communications, or deeds. In such cases, the established deadlines have not been met;
  • Omission, i.e., failure to submit an application, communication, or deed as established by law. 

Violators

Those who are responsible for submitting applications, communications, and deeds to the Business Register are also responsible for violations of the relevant rules. 

Amount of penalties for companies and consortia

The amount varies from € 103.00 to € 1,032.00 (as provided for in art. 2630 c.c.).
If an application, communication, or deed is submitted within 30 days of the established deadline, the relevant penalty is reduced to one-third of its total amount; therefore, it varies from € 34.33 to € 344.00.
If the payment is made within 60 days of the notification of a penalty, you can choose either to pay double the amount of the minimum penalty, or to pay one-third of the maximum, in addition to the procedural costs (as provided for in art.16 of Law 689/1981).

For example: 

  • If the application, communication, or deed is submitted within 30 days of the deadline, and the payment of the penalty is made within 60 days of its notification, the reduced amount is of € 68.66;
  • If the application, communication, or deed is submitted more than 30 days after the deadline, and the payment of the penalty is made within 60 days of its notification, the reduced amount is of € 206.00.

For omission of submitting annual accounts, the administrative penalty will be increased by one-third (as provided for in art. 2630 c.c.).
