The Chamber of Commerce of Milan Monza Brianza Lodi is a market surveillance body in the fields that are established by law. In such fields, it has territorial and functional competence.
As a consequence, the Chamber has set up the Public Trust Office, which carries out inspections, sometimes in collaboration with other public bodies, in the following areas:

1. Safety and compliance of products

  • Toys
  • Electrical products
  • Protective Personal Equipment (first category)
  • Eco-design of energy-related products
  • Product safety, pursuant to art. 102 et seq. of the Consumer Code

2. Labelling and consumer information

  • Labelling of textile products
  • Labelling of footwear
  • Information on CO2 emissions and new cars’ fuel consumption
  • Information on energy efficiency of energy-related products

3. Various economic activities

  • General warehouses
  • Use of the name “Chamber of Commerce”

Controls concern businesses that produce, import, or distribute products falling within the aforementioned areas. Such controls are carried out according to the regulations in force (law 689/81 and sector-specific rules) and to the procedures established at national or local level.

Administrative pecuniary sanctions are applied as a consequence of violations ascertained by a formal written notice. The amount of the sanctions must be paid to the State Treasury via a F23 form. Notification and procedural costs amount to € 17 and must be paid to the Chamber of Commerce via the SIPA portal. Control activities entail carrying out inspections (online or on the ground) through:
  • visual checks that are intended to verify formal compliance with the relevant norms (i.e., display of compulsory indications related to a certain product, lack of evident non-conformities);
  • documentary checks on technical dossiers of specific products. These back office checks are carried out in collaboration with notified bodies, and are aimed at ascertaining the compliance of products with the technical requirements established by mandatory/ voluntary regulations;
  • physical checks that consist in subjecting products samples to laboratory tests, in order to ascertain the construction features of the checked products in collaboration with notified bodies / authorized laboratories.

Surveillance activities are carried out on the basis of reports, surveillance plans and memoranda of understanding established at national or local level. The criteria for singling out the businesses/products to be checked are foreseen in the current procedures and usually include a random draw from predetermined lists.
