Renewing a trademark
A registration provides a trademark with ten-year protection, which is indefinitely renewable for ten-year periods.
When to submit a renewal application
National Trademark
The registration of a National Trademark provides a ten-year protection starting from the application filing date.
The relevant renewal application can be submitted up to twelve months before the ten-year expiry date.
The expiry date is defined as the last day of the month which the application filing date falls within.
For instance, if a registration application was filed for the first time in June 2008, the relevant renewal application has to be submitted before the 30th of June 2018 (in any case, no more than a year before).
The renewal application can also be submitted within six months of the expiry date, after paying a late application fee.
EU Trademark
The renewal procedure is managed exclusively by the European Union Intellectual Property Office (EUIPO) based in Alicante (Spain).
International Trademark
The registration of an International Trademark provides a ten-year protection from the registration date (please note the difference between the Italian/European registration).
The relevant renewal application can be submitted up to six months before the ten-year expiry date.
Before the expiry date, the WIPO sends the holder of the trademark a notification confirming the expiry date of the international registration.
The renewal application can also be submitted within six months of the expiry date, paying a late application fee.
A trademark can be renewed in all of the countries indicated in the registration application or in some of them only. When renewing, the following modifications are not allowed:
-trademark;
-classes of goods/services;
-neither holder nor his/her personal data.
Any modification can be submitted separately, before or after the renewal.
