It is the set of rights that ensure the protection of the creations of the human mind in the artistic, scientific and industrial fields. It includes:
- Industrial property: patents, trademarks and other rights recognised at national, Community and international level.
- Protection of software, know-how, copyright and confidential information.
Databases
All data relating to trademarks and patents filed with the Patent and Trademark Offices (PTO) can be consulted on online databases which are freely accessible and free of charge.
Effective consultation requires a certain degree of knowledge of the search tools and methods specific to each database. In addition, we recommend to analyse and interpret the published data from a legal point of view:
- please read carefully the instructions, legal notes and disclaimers limiting liability provided by the database operators;
- always check that the information obtained are complete and up-to-date.
The consultation of the databases in addition to providing information about your application for registration of a trademark or patent, is also useful for carrying out the so-called clearance search to verify its requirement of novelty.
A clearance search is not mandatory by law and does not provide absolute guarantees, but it significantly limit the risk of civil or penal legal action.
The search can be carried out in three ways:
- autonomously and for free on the trademark/patent databases published online
- through the Assistance Service offered by the Chamber of Commerce
- by contacting qualified experts at professional studios
