Since 1 January 2012, public administrations and public service operators can no longer request or accept certificates from their users.
All certificates must contain this statement:
"This certificate cannot be presented to public administrations or to public service operators". Without such statement, the certificate is considered null and void.
The certificate is a stamped document and has legal value; it certifies that a business is registered in the Business Register and in the REA (Economic and Administrative Index), kept by the Italian Chambers of Commerce.
It is valid for six months. It can be issued to all the businesses registered with the Italian Chambers of Commerce and in good standing with the payment of the annual fee.
The certificate is valid and usable by a private individual/body only in relation with another private individual/body.

Anti-mafia certificates

As a result of Leg. Decree 218/2002, the Chambers of Commerce are no longer authorized to issue certificates containing the anti-mafia statement to private individuals, to public administrations, or to public service operators.

Public administrations, public service operators and SOA (Construction Business Control Company) must acquire the necessary documentation, to carry out anti-mafia checks on businesses, only from the competent Prefectures.
Private individuals, instead, certify their anti-mafia requirements by self-certification.

Declaration of validity (i.e. absence of insolvency proceedings)

You can request that each certificate contain a declaration of validity, i.e absence of insolvency proceedings against the business concerned. However, this is not possible for certificates of deposit, of ownership structure and of non-registration.

You can request one of the following declarations of validity:

  • declaration of current validity: it certifies that the business, at the time of the request, is not subjected to insolvency proceedings.
  • declaration of previous validity: it certifies that the business, since its birth, has never been subjected to insolvency proceedings.

Such declarations, when they concern businesses registered with the Chambers of Benevento, Caserta, Catanzaro, Matera, Pesaro e Urbino, Vibo Valentia, cannot be issued by the Chamber of commerce of Milan Monza Brianza Lodi.

The declaration of validity cannot be issued when it concerns businesses that have been deleted from the Business Register.
 

Affixing an apostille to a certificate

It may be required that certificates designed for use abroad contain an apostille, which must be requested from the local Prefecture.

  • ATECO classification of economic activities (issued by ISTAT , The Italian National Institute of Statistics);
  • certificate of environmental quality;
  • number of employees;
  • residence/domicile of people with corporate positions/qualifications;

is contained only in the company profiles, not in the certificates issued by the Business Register.
