Controls and sanctions related to textile products
Sanctions for the violation of EU Regulation 1007/2011
- Unless the fact constitutes a criminal offence, the manufacturer or importer who, in violation of art. 15(1) of EU Regulation 1007/2011, markets a textile product without a label or marking displaying data and names of the fibre composition will be subject to an administrative sanction ranging from € 3,000 to € 20,000.
- The aforementioned administrative sanction will also be applied to the manufacturer or importer who markets a textile product whose accompanying commercial documentation, which substitutes label or marking, lacks fibre composition data in violation of art. 14(2) of EU Regulation 1007/2011.
- Unless the fact constitutes a criminal offence, the distributor who, in violation of art. 15(3) of EU Regulation 1007/2011, markets a textile product without a label or marking displaying fibre composition data will be subject to an administrative sanction ranging from € 700 to € 3,500.
- Unless the fact constitutes a criminal offence, the manufacturer or importer who, in violation of Articles 14(1) and 15(1) of EU Regulation 1007/2011, markets a textile product with a fibre composition differing from that displayed on the label/ accompanying commercial documentation (without prejudice to the tolerances referred to in art. 20 of EU Regulation 1007/2011) will be subject to an administrative sanction ranging from € 1,500 to € 20,000.
- Unless the fact constitutes a criminal offence, the distributor who, in violation of Articles 14(1) and 15(2) of EU Regulation 1007/2011, markets a textile product with a fibre composition, displayed on the label, not corresponding to the one displayed in the accompanying documentation will be subject to an administrative sanction ranging from € 700 to € 3,500.
- Unless the fact constitutes a criminal offence, the manufacturer or importer who, in violation of Articles 5 and 15(1) of EU Regulation 1007/2011, markets a textile product with a label displaying fibre names different from those listed in Annex I of EU Regulation 1007/2011 or expressed in abbreviations, in non-descending order, in a language different from Italian will be subject to an administrative sanction ranging from € 1,500 to € 20,000.
- Unless the fact constitutes a criminal offence, the distributor who, in violation of Articles 5 and 15(2) of EU Regulation n. 1007/2011, markets a textile product with a label displaying fibre names different from those listed in Annex I of EU Regulation 1007/2011, or expressed in abbreviations, in non-descending order, in a language different from Italian, as well as incorrectly displaying the phrase "Contains non-textile parts of animal origin" will be subject to an administrative sanction ranging from € 200 to € 1,000.
- Unless the fact constitutes a criminal offence, the manufacturer, importer, or distributor who, in violation of art. 16 of EU Regulation 1007/2011, when marketing a textile product does not display the fibre composition in catalogues, leaflets, or websites will be subject to an administrative sanction ranging from € 1,500 to € 20,000.
- Unless the fact constitutes a criminal offence, the manufacturer or importer who, in violation of art. 12 of EU Regulation 1007/2011, markets a textile product containing non-textile parts of animal origin without displaying the phrase "Contains non-textile parts of animal origin" on its label or marking will be subject to an administrative sanction ranging from € 1,500 to € 20,000.
- The surveillance authority may hold that the examined textile products are without labelling or incorrectly labelled and therefore in violation of EU Regulation 1007/2011. In this case, it ascertains and notifies the violation of the aforementioned norms assigning, pursuant to art. 13-14 of Law 689/1981, a peremptory term of 60 days for the regularization, labelling, or withdrawal of the products to the manufacturer/marketing responsible.
- Unless the fact constitutes a criminal offence, those who do not comply with the legal requirements established in paragraph 10 within the set time frame will be subject to an administrative sanction ranging from €3,000 to € 20,000.
- The aforementioned provisions will not apply to textile products referred to in art. 2(3-4) of EU Regulation 1007/2011.
Authorities in charge of control
The Ministry of Economic Development, Department for Enterprises and Internationalization, Directorate General for Industrial Policy, Innovation, and Small/Medium Enterprises - Division VII is the competent authority for controls on the fibre composition labelling of textile products, in collaboration with Chambers of Commerce.
Surveillance is also carried out by institutions with general competence, such as Local Police, Financial Intelligence, etc.
Verification procedures
- Visual and documentary control. Visual control is aimed at verifying that a textile product is accompanied by a label/marking displaying fibre composition, following EU Regulation 1007/2011 and Legislative Decree 194/1999. If the control is carried out on a distributor that does not sell to final consumers, it will concern not only the existence of the required label/marking, but also the commercial documentation containing the product composition.
- Physical control. It entails taking and analyzing samples in order to ascertain the actual product composition and the equivalence between the latter and what is displayed on the product label.
